Introduction:

Welcome to JAUCE, operated by Nichido Logistics Inc. JAUCE is a trusted bridge to Japan’s online marketplaces, offering a platform to access Japanese online auctions and shopping sites with ease. JAUCE’s goal is to provide a transparent and reliable service for global users. By using JAUCE, users agree to the terms laid out in this User Agreement. It is crucial that users read and understand the entire agreement before using JAUCE platform to ensure a smooth experience.

Definitions:

JAUCE: Refers to the platform operated by Nichido Logistics Inc., which provides users access to Japanese online auctions and shopping sites.
User: Any individual or entity that registers, accesses, or uses the JAUCE platform.
Services: All the offerings provided by JAUCE, including but not limited to Auction Deputy, Proxy Shopping, Payment Handling, Seller Liaison, Receiving and Storage, and International Shipping.

Registration and Account:

To register on JAUCE platform, users must be at least 18 years old, have the legal capacity to enter into binding contracts, and provide accurate, current, and complete information during the registration process.

Services Offered:

JAUCE operates as a platform and acts as a deputy service, facilitating global users’ access to Japanese online auctions and shopping platforms. JAUCE processes purchases on behalf of the users, ensuring a seamless transaction experience. The primary role of JAUCE is to bridge the gap between users and various Japanese online marketplaces. It’s important to note that JAUCE does not make any product suggestions; users are free to select and make their purchases independently. The suite of services JAUCE provides encompasses:
Auction Deputy: JAUCE offers a system that enables users to browse, search, translate auction listings, and place both real-time and sniper bids independently.
Proxy Shopping: Post-auction or after a direct purchase, JAUCE efficiently processes orders from online platforms in Japan.
Payment Handling: JAUCE facilitates timely payments to sellers, representing the interests of the user.
Seller Liaison: JAUCE acts as a communication bridge, ensuring seamless interactions between users and sellers.
Receiving and Storage: Purchased items are securely received and stored in JAUCE’s designated warehouses, awaiting further instructions from the user.
International Shipping: JAUCE diligently oversees the international shipping process, ensuring items are handled with care, packed according to international shipping standards, and accompanied by necessary shipping documents to ensure smooth customs and delivery procedures.
It’s crucial for users to understand that while JAUCE provides a transactional platform, JAUCE does not have control over, nor does it vouch for, items being “as described” by sellers. JAUCE emphatically recommends users exercise due diligence and caution when making purchases.

Fees:

Currency: All transactions on JAUCE are exclusively processed in Japanese Yen (JPY). While JAUCE accepts payments only in this currency, it does not handle currency exchange. Instead, any currency conversion is managed by the payment processor.
Transparency: For a comprehensive breakdown of JAUCE’s fee structure, please refer to the Our Fees page.
User Responsibilities: Users are responsible for all fees associated with their transactions on JAUCE. This includes service charges, shipping, storage, insurance, and any applicable taxes, both before and after shipment.
Notification of Changes: JAUCE prioritizes transparency and fairness. Should there be any changes to the fee structure, JAUCE will inform users via notices on its website. It is recommended for users to frequently visit the JAUCE website to stay updated on any such modifications.

Deposits:

Users are required to deposit either the full item price or the amount of their maximum bid before bidding or making a purchase on JAUCE. Before JAUCE releases items for international shipping, users must settle all outstanding fees. This includes fees for shipping and any additional charges. JAUCE may, at its discretion, waive the deposit requirement under certain circumstances, such as for users of its loyalty program. Users have the option to request refunds in cases of unsuccessful auction bids or if there are excess payments. These requests should be submitted through the refund order page. JAUCE ensures that refunds are processed manually and directed solely to the original funder’s account.

Return & Cancellation Policy:

At JAUCE, customer satisfaction and trust are prioritized. JAUCE understands that sometimes things don’t go as planned and is here to support its users. JAUCE’s Return & Cancellation Policy is designed to be fair, transparent, and consistent with the best industry practices.
Conditions for Returns:
Item Discrepancies: If the item delivered is incorrect, significantly differs from its description, or is misrepresented on JAUCE’s website.
Defective or Damaged Goods: If the item the user receives is defective or damaged upon arrival, and the damage was not caused during the shipping process.
Missing Parts or Accessories: If the product arrives without essential components or accessories that were included in the product description.
Failed Delivery: If the product does not reach the specified delivery address and the issue is NOT attributed to customs complications, courier errors, incorrect address details provided by the user, recipient absenteeism, or the user’s active rejection of the delivery.
Unauthorized Charges: If a user’s account is charged without authorization for a product they did not order.
Damaged or Lost During International Delivery: If items are damaged or lost during international delivery, an insurance process must be followed. In certain instances, a damage report issued by the carrier or other relevant documentation may be necessary. Users commit to complying with and collaborating throughout this process.
Cancellation:
When users place a bid or order on Japanese online marketplaces through JAUCE, they’re making a commitment. If users ever find themselves needing to cancel a bid or purchase order, it’s essential to reach out to JAUCE customer support promptly. However, it’s important to note that while JAUCE will do its best to assist, cancellations are not always possible. JAUCE cannot cancel orders unilaterally; the seller’s explicit agreement is also required. In the event of a successful cancellation, refunds will be processed in accordance with JAUCE’s refund policy. However, any fees or penalties arising from the cancellation will be deducted from the refund amount. International shipping fees are not subject to a refund.

Storage and Shipping:

Receipt of Items: All items purchased via JAUCE are first delivered to our designated warehouses in Japan. Users bear any charges related to this domestic delivery.
Storage Duration and Fees: JAUCE provides free storage for items for up to 60 days from their arrival at JAUCE’s warehouse.
If storage beyond the initial 60 days is needed, extra fees will be incurred. Detailed information about these fees is available on our Storage Fees page.
Unclaimed Items: Items left in our warehouse for over 120 days without shipping directives or communication from the user will be considered abandoned.
If items are abandoned, JAUCE reserves the right to dispose of them.
Communication: JAUCE urges users to maintain regular communication about their stored items. JAUCE will notify users as the end of the complimentary storage period nears and again before taking any disposal actions.
International Shipping: JAUCE specializes in international shipping services; therefore, JAUCE does not facilitate shipments to addresses within Japan.
Packaging: By default, JAUCE prepares items for international shipment using standard packaging methods. If a user seeks specialized handling for their items, they may incur additional fees, as detailed on the Our Fees page.
Shipment Details: Users must provide precise and comprehensive shipping details on the designated shipment order form. Any inaccuracies or missing information can lead to delays or misdeliveries, and JAUCE will not be accountable for such issues.
Address Verification: For security reasons, shipments will be sent to the address linked with the user’s PayPal account. Drop shippers should ensure the final recipient’s address is given during payment.
Uncontrollable Delays: JAUCE is committed to prompt deliveries. However, unforeseen factors like customs checks, carrier interruptions, or natural events can cause delays. JAUCE is not responsible for delays arising from such circumstances.

Customs Processing:

JAUCE ensures that items are shipped in accordance with Japan’s export regulations. By default, JAUCE provides shipping labels and invoices for all shipments. Should there be a need for additional documentation, extra charges may be incurred. JAUCE describes items with accuracy and transparency. JAUCE does not reduce values on invoices or label items as gifts. Users must anticipate and bear any import fees before making purchases through JAUCE. Users are entrusted with the responsibility of managing customs procedures in the destination country. This encompasses activities like completing customs forms, settling tax payments, responding promptly to customs notifications, and furnishing any supplementary documents if demanded. Users are solely responsible for handling and bearing all customs taxes, duties, penalties, and fines, both before and after shipment. Should an item be returned to JAUCE due to customs complications, or if a user opts against clearing customs, all responsibilities and consequences fall on the user. Items that are confiscated or destroyed by customs due to non-compliance will not be eligible for refunds. Furthermore, any costs associated with international returns will be borne by the user.

Prohibited Items and Shipping Restrictions:

General Prohibition: JAUCE strictly prohibits the purchase, sale, or shipment of any items listed on our Restricted Items page.
Consequences for Violations: Users attempting to purchase prohibited items may face immediate account suspension or termination. In certain cases, they may also be reported to the relevant authorities.
Shipping Restrictions: Some items might be restricted from shipping due to their size, nature, or content. Before making a purchase or placing a bid, users are advised to consult our Restricted Items Page or Customer Support Service. Failure to do so may result in additional fees, delays, or the inability to ship the item.
Consequences for Policy Violations: Violations of this Restrictions Policy can lead to actions against the user’s account. These actions can range from warnings to suspension or termination. JAUCE reserves the right to determine the appropriate action based on the severity of the violation.
Updates to Restrictions: The list of restricted items may be updated periodically by JAUCE. Users are encouraged to regularly review the Restricted Items Page to stay informed.

Limitation on Liabilities:

JAUCE offers services on an ‘as is’ and ‘as available’ basis, based on current capabilities and availability. While JAUCE aims for excellence, JAUCE cannot guarantee uninterrupted or error-free service.
No Implied Warranties: JAUCE renounces all warranties, both express and implied, including but not limited to the implied warranties of merchantability, fitness for a specific purpose, and non-infringement.
Limit on Direct Damages:
Definition: “Direct damages” pertain to tangible losses directly resulting from a breach of this User Agreement or any complications arising from using JAUCE’s services. This excludes consequential, incidental, or indirect losses.
Liability Cap: To the maximum extent permitted by applicable law, JAUCE’s total liability for any direct damages shall not surpass the cumulative amount of JAUCE service fees paid by the user in the twelve (12) months preceding the event leading to the claim, or $200. This limitation is applicable to any claims related to the services provided by JAUCE or this User Agreement.
Exclusion of Indirect Damages: JAUCE will not be held accountable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or data use.
Intentional Misconduct and Gross Negligence: Regardless of other provisions in this Agreement, JAUCE’s limitations on liability will not be applicable in instances where it is established that the harm or damage was a consequence of JAUCE’s intentional misconduct or gross negligence. In such cases, JAUCE will be liable for all direct damages, with the extent of this liability determined by relevant laws and regulations. This clause ensures JAUCE’s accountability for actions reflecting a deliberate intent to inflict harm or a significant neglect of its responsibilities.

Assignment and Delegation:

Users are prohibited from assigning or delegating their rights or obligations under this Agreement. Merging or transferring accounts is not permitted. Users who maintain multiple accounts with JAUCE must manage each account individually. Furthermore, items associated with distinct accounts cannot be consolidated for a single shipment.

Account Security:

Password and Account Confidentiality: Users are responsible for maintaining the confidentiality of their login details. Choose a strong password, change it periodically, and avoid sharing it with others.
Inactive Account Precaution: If an account with a remaining balance remains inactive for one year, JAUCE will send a notification and subsequently deactivate the account as an anti-fraud precaution.
Logging Precautions: Users should avoid logging into JAUCE from shared or public computers. If users suspect unauthorized access or any security breaches, they should notify JAUCE immediately.

External Links and Third Parties:

JAUCE might offer external links or syndicate content from third-party platforms or services. JAUCE neither endorses nor assumes responsibility for the content, actions, or policies of such external entities. Users access these at their discretion and risk. JAUCE also provides third-party tools like web translators or currency converters for convenience. JAUCE does not endorse or verify their accuracy and is not responsible for any damages or losses resulting from their use. Users should use these third-parties at their own discretion. Features and availability may change without notice.

User Data Retention and Deletion:

Users reserve the right to request the removal of their account and all related data. When receiving this request, JAUCE will begin the procedure to erase the user’s information from the active database during the next backup cycle. To request account and data deletion, users should access the JAUCE customer support area using their login credentials. If logging in is not feasible, users can send a request from the email address associated with their account. In cases where both options are unavailable, please reach out to us, providing a scanned copy of a valid photo ID for verification purposes.

Inactive Accounts Policy:

Criteria for Determining Account Inactivity:
An account is considered inactive if there’s no activity for a continuous 12-month period.
Initial Notification Process:
JAUCE will send email notifications to account holders upon detecting such inactivity.
Deactivation and Reactivation:
Should the account remain inactive for an additional 12 months, JAUCE will deactivate it to safeguard against unauthorized access and potential fraud. To reactivate, account holders must log in within the following 9 years.
Account Termination:
Accounts left unclaimed after 9 years will be permanently closed. Any remaining balances will be handled as per the local Japanese laws in effect at that time.

Intellectual Property:

All content displayed on JAUCE’s platform, including, but not limited to, text, graphics, logos, and images, is protected under applicable intellectual property laws. Any unauthorized use, reproduction, or distribution of content from JAUCE’s platform is expressly forbidden. Should there be any infringement of its intellectual property rights, JAUCE reserves the right to pursue legal remedies.

Communication:

JAUCE primarily communicates with users through the CMS software in JAUCE’s customer support area, using its dedicated contact form. For general announcements and updates, JAUCE relies on website notifications and email. Additionally, JAUCE sends email notifications to users regarding the status of their auction bids, including notifications for being outbid, winning bids, and other related updates.
Users bear the responsibility for their actions on our platform. This encompasses compliance with all local laws and regulations, understanding the risks tied to online auctions and purchases, and taking measures to safeguard their interests.
Problem Resolution: Should users have any concerns or issues with JAUCE services, it is recommended to first contact JAUCE’s customer support service. JAUCE is committed to providing prompt and amicable solutions.
Individual Disputes: All disputes shall be addressed on an individual basis, and both parties hereby waive any right to bring class or representative actions.
Governing law and Jurisdiction: Any legal actions arising out of or related to this Agreement shall be brought exclusively in the courts located in Yonago City, Japan. Both parties hereby consent to and agree upon this jurisdiction.

Miscellaneous:

Entire Agreement: This Agreement constitutes the complete understanding between JAUCE and the user, superseding all previous agreements and understandings, both written and verbal.
Updates & Changes: JAUCE may periodically update this Agreement. While JAUCE strives to inform users of significant changes, it is the user’s responsibility to regularly review this Agreement on JAUCE website.
Compliance with Laws: Users are obligated to comply with all relevant laws and regulations.
Severability: If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in effect.
Force Majeure: JAUCE is not liable for any service interruptions caused by events beyond our control, such as natural disasters, strikes, civil disturbances, or government actions.
Termination: JAUCE reserves the right to terminate a user’s access if they breach this Agreement.
Waiver: A failure by JAUCE to enforce any provision of this Agreement does not constitute a waiver of that provision.
